HB426

Real property; creation of the Alabama Property Protection Act of 2026, title fraud prevention

Chamber Passed·3/17/26

Alabama Property Protection Act of 2026 establishes best practices for title agents, attorneys, realtors, and notaries public to prevent title fraud.

The Alabama Property Protection Act of 2026 provides best practices for title agents, attorneys, realtors, and notaries public to prevent title fraud. It establishes an expedited quiet title process for victims of title fraud and provides for the recovery of costs and attorney fees in certain quiet title actions. The act also prohibits remote notarization of documents conveying interest in real property under certain circumstances and makes nonsubstantive, technical revisions to update the existing code language to current style.
